Per Labor Code Article 86, every employee working between 10:00 PM and 6:00 AM is entitled to additional compensation of not less than 10% of their regular wage for each hour of night work.

  • What is the night differential rate in the Philippines?
    Per Labor Code Article 86, every employee working between 10:00 PM and 6:00 AM is entitled to not less than 10% of their regular wage for each hour worked during the night zone.
  • Does night differential stack with overtime?
    Yes, night-diff stacks with overtime. Example: a regular 10PM-6AM shift earns 110% (regular + 10% night-diff). Overtime hours within that zone earn 110% × 125% = 137.5%.
  • How does WORKSPHR detect night-diff hours?
    WORKSPHR analyzes each clock-in/out event against the 10PM-6AM zone with minute-level precision. Even partial hours within the zone (e.g. shift starts 9:45 PM) get the night-diff portion correctly.
  • What about rest day on a night shift?
    Rest day pay = 130% of regular. If on a rest day in the night zone: 130% (rest day) + 10% (night-diff) = 140%. Rest day OT in night zone = 169% × 1.10 = 185.9%. WORKSPHR computes all stacks automatically.
  • Is night differential mandatory for all employees?
    Yes for rank-and-file. Managers, field personnel, and family members are exempted per Article 82. WORKSPHR distinguishes employee classifications correctly.

  • Does Sunday work get night differential?
    Yes, Sunday is a typical rest day. Working in the night zone on a Sunday gets rest day pay (130%) + night-diff (10%) = 140%. If overtime on Sunday in night zone: 169% × 1.10 = 185.9%.
  • What if my company gives more than 10%?
    Some BPOs offer 15-25% night-diff premium per CBA or company policy. WORKSPHR handles custom percentages per role/department. The 10% is the legal minimum; you can exceed it.
